Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Trustawork platform at trustawork.com (the "Platform"), operated by Trustawork Technologies Limited ("Trustawork", "we", "us"). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements to use the Platform. By using the Platform, you represent and warrant that you meet these requirements. If you are registering on behalf of a business, you represent that you have authority to bind that business to these Terms.

3. The Trustawork Platform

Trustawork is a technology platform that connects clients with independent, verified workers for temporary and flexible work engagements. Trustawork is not an employment agency and does not employ the workers listed on the Platform. Workers are independent service providers who choose to offer their services through the Platform.

Trustawork acts as an intermediary and payment escrow agent. We facilitate the booking, clock-in/out, and payment process, but we are not a party to the service agreement between you and any worker.

4. Client Accounts

To use the Platform, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@trustawork.com if you suspect unauthorized access to your account.

5. Posting Shift Requests

When you post a shift request, you agree to:

Shift requests are reviewed and approved by Trustawork before becoming visible to workers. We reserve the right to reject any request that violates these Terms or our Community Guidelines.

6. Payments and Escrow

When you book a worker, payment is collected upfront and held in escrow by Trustawork. Funds are released to the worker only after the shift is completed and clocked out. This protects you — you only pay for work that is actually done.

All payments are processed through Flutterwave. By making a payment, you agree to Flutterwave's terms and conditions.

Prices displayed include Trustawork's platform service fee. The total amount due is shown clearly before you confirm any booking.

9. Clock-In and Clock-Out

Trustawork uses a PIN-based clock-in/clock-out system. You are responsible for providing the correct PIN to the worker when they arrive to start the shift, and again when they finish. Inaccurate time verification may affect billing. Do not share PINs prematurely or after the shift has ended.

10. Reviews and Ratings

After each completed shift, you may leave a rating and review for the worker. Reviews must be honest, fair, and based on your genuine experience. We prohibit false, defamatory, or retaliatory reviews. Trustawork reserves the right to remove reviews that violate these guidelines.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Trustawork is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any services obtained through it. Trustawork's total liability to you for any claim arising from these Terms or the Platform shall not exceed the total fees paid by you to Trustawork in the three (3) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Trustawork Technologies Limited and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of the Platform, your breach of these Terms, or your violation of any applicable law or the rights of any third party.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or conduct harmful to workers, other clients, or Trustawork. You may also close your account at any time by contacting us at hello@trustawork.com.

15. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Rivers State, Nigeria.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Platform. Your continued use of the Platform after any changes constitutes your acceptance of the updated Terms.
