TrustaWorker App — Terms of Service

These Terms of Service ("Terms") govern your use of the TrustaWorker App mobile application ("App"), operated by Trustawork Technologies Limited, trading as Trustawork ("we", "our", or "us"). By downloading or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

• You must be at least 18 years old to use the App.
• You must be legally permitted to work in Nigeria.
• You must complete identity verification (phone OTP and, where required, NIN + facial liveness) before accessing paid shifts.
• You may only hold one worker account.

2. Your Account

You are responsible for keeping your login credentials secure. You must provide accurate, current, and complete information during registration and keep your profile up to date. We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

3. Shift Conduct

• You must arrive on time for every shift you accept. Repeated late arrivals or no-shows will reduce your reliability score and may result in suspension.
• You must use the in-app clock-in and clock-out codes provided by the Client. Falsifying attendance is grounds for immediate termination of your account.
• You must behave professionally and respectfully toward clients, their staff, and their customers at all times.
• You must not share shift details, contact information, or addresses with third parties.
• If you need to cancel a confirmed shift, you must do so with as much notice as possible. Cancellations within 24 hours of the shift start time will negatively affect your reliability score.

4. Confirmation Obligation

For shifts that require confirmation, you will receive a prompt between 48 and 24 hours before the shift starts. Failing to confirm by the deadline will be treated as a missed confirmation and will affect your reliability score. Repeated missed confirmations may result in the shift being reassigned.

5. Earnings and Payments

• Earnings are held in escrow and released to your wallet after a shift is completed and approved by the client.
• Withdrawals are processed via Flutterwave to your registered Nigerian bank account. A minimum withdrawal amount of ₦500 applies.
• Trustawork is not responsible for delays caused by your bank or payment processor.
• Tip amounts and transport reimbursements shown on shifts are at the client's discretion and are not guaranteed unless explicitly confirmed by the client.

6. Reliability Score

Your reliability score is calculated from a rolling window of your last 35 countable events and determines your worker tier. Your tier affects how quickly you receive notifications about new shifts. We reserve the right to adjust the scoring formula and tier thresholds at any time.

7. Prohibited Conduct

• Creating fake accounts or impersonating another person.
• Manipulating your reliability score through fraudulent means.
• Harassing, threatening, or discriminating against clients or other users.
• Using the App for any unlawful purpose.
• Attempting to circumvent the platform by arranging payments directly with clients outside the App.

8. Suspension and Termination

We may suspend or permanently ban your account for violating these Terms, engaging in fraud, or any behaviour that harms other users or the integrity of the platform. If your account is suspended, pending earnings will be reviewed and released or forfeited depending on the circumstances.

9. Intellectual Property

The TrustaWorker App, including its design, source code, algorithms, trademarks, logos, and all content on the platform, is the exclusive property of Trustawork Technologies Limited. All rights are reserved.

• Licence to use — We grant you a limited, personal, non-transferable, non-exclusive licence to use the App solely for the purpose of finding and managing shift work through the platform. This licence does not convey any ownership rights.
• Trademarks — "Trustawork", "TrustaWorker", and associated logos are trademarks of Trustawork Technologies Limited. You may not use them without our prior written consent.
• Your content — You retain ownership of content you submit to the platform (such as your profile photo and biography). By submitting it, you grant us a licence to display and use it for the operation of the platform.
• Restrictions — You may not copy, modify, distribute, reverse-engineer, or create derivative works from any part of the App or its technology.

10. Limitation of Liability

Trustawork is a platform that connects workers with Clients. We do not employ workers or clients and are not responsible for the working conditions, safety, or equipment at any shift location. Workers attend shifts at their own risk and are encouraged to assess conditions before starting work.

To the maximum extent permitted by law, Trustawork's total liability for any claim arising from your use of the App is limited to the amount you earned through the platform in the 30 days preceding the claim.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the App. Your continued use of the App after the effective date of updated Terms constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved in the competent courts of Nigeria.
